But do not prematurely panic and think that if you forgot to pay a receipt for utility bills a couple of times, you will immediately receive a ban. A ban on the departure of a citizen of the Russian Federation from the country can only be established by a court, applying Article 67 of Law No. 229-FZ. Without a court decision, neither the bailiffs, nor even the management company, despite all the threats, can forbid you to travel abroad on your own.
To establish a ban, you must first accumulate the amount of debt for housing and communal services and other debts of at least 30,000 rubles. This minimum amount is regulated by law (federal law "on enforcement proceedings" of 02.10.2007 N 229-FZ), and from October 1, 2017 is set at at least 30,000 rubles. The amount of debts is taken into account in total, i.e. if, for example, you have accumulated 29 thousand fines for traffic rules, and 2 thousand for housing and communal services, then in total it will be more than the established limit, and a restriction on departure will be imposed.
After you have accumulated a sufficient amount, the management company must sue you for debt collection, and only after that can a travel ban be imposed. From the court, the court decision goes to the Federal Bailiff Service, and the bailiffs already transmit this information to the border service of the FSB, who will "deploy" you at the border.
This whole procedure takes a lot of time, so do not panic if you have missed payment several times on a receipt for utility bills. But you should not relax and accumulate debts, because you may have other forgotten debts that the court, at the suggestion of the bailiff service, can take into account in total.
What to do if the ban is already set
If you know that you can not be released abroad because of debts for housing and communal services, then do not panic, you just need to take the right action. To pay off the debt, being at the airport or at the land border, will not work. In order for the travel restriction to be lifted, the bailiff must issue the same decision as with the ban. He can do this only the next day after the funds are credited to the recipient's account. To do this, you must fully pay the debt, and inform the bailiffs about it.
It is important to understand that bailiffs should not monitor the repayment of your debts, so if you do not notify them and do not provide the relevant documents, the ban will not be lifted. And if you go to the airport with a bunch of paid receipts bypassing the bailiffs, and show them at the border to the border guards, you still will not be released. Also, you will not be allowed to travel to another country if you provide copies of the ruling that the ban has been lifted. The whole procedure takes place through the bailiff, and the FSB border service has 30 days to execute his decision.
